Candidate Application Terms

These Candidate Application Terms (“Terms”) apply to any individual who applies for a role through Finiten Ltd (“Finiten”, “we”, “us” or “our”), submits a CV or other application materials to us, creates a candidate profile with us, applies through a third-party platform or job board, or is approached directly by a Finiten consultant, recruiter or search professional in connection with current or potential job opportunities.

This includes, without limitation, applications or expressions of interest made through our website, careers pages, applicant tracking systems, email, LinkedIn, Indeed, CV databases, other job boards, social media platforms, referrals, networking activity, direct sourcing, executive search activity, or any other channel through which we provide recruitment services.

By submitting information to us, applying for a role, responding to an approach from us, or otherwise engaging with our recruitment services, you agree to these Terms.

1. About Finiten
​

Finiten is a recruitment consultancy. Depending on the nature of the vacancy or assignment, we may act as:

  • an employment agency in relation to the introduction of candidates to clients for permanent or fixed-term employment; and/or

  • an employment business in relation to temporary, contract or interim assignments.

 

Additional assignment-specific terms may apply where we engage individuals for temporary, contract or interim work.

 
2. Scope of these Terms
​

These Terms apply whether:

  • you apply directly to a vacancy advertised by Finiten;

  • you submit your CV or details to us on a speculative basis;

  • you apply through a third-party website, job board or platform such as LinkedIn, Indeed or another provider;

  • your details are provided to us through a referral;

  • we identify and approach you directly regarding a role or potential role; or

  • we consider your profile for current or future recruitment opportunities.

Where you apply or engage through a third-party platform, your use of that platform may also be subject to that platform’s own terms, privacy notices and policies. These Terms apply to your relationship with Finiten in connection with our recruitment services.

 
3. Applying for a role
​

When you apply for a role or otherwise provide information to us, you confirm that, to the best of your knowledge and belief:

  • the information you provide is true, accurate, complete and not misleading;

  • your CV, application form, cover letter, employment history, dates of employment, qualifications, professional memberships, compensation details, notice period, right-to-work status and other information supplied by you are accurate;

  • you are entitled to provide that information to us; and

  • you will tell us promptly if any material information changes during the recruitment process.

ou are responsible for ensuring that any information submitted on your behalf by a third party, or contained in a third-party profile or job-board application, is accurate and up to date.

 
4. Applications through third-party websites and direct approaches
​

Where you apply through a third-party website, job board or platform, or where we approach you directly as part of search, sourcing or networking activity:

  • we may receive your CV, profile details, contact information and other relevant application data from that source;

  • we may contact you to discuss a specific vacancy, your background, your suitability for a role, or other potentially relevant opportunities;

  • your response to our approach, or your continued engagement with us, will be treated as confirmation that you are willing for us to consider your details for recruitment purposes in accordance with these Terms and our Privacy Notice; and

  • before we submit your CV or personal details to a client for a specific vacancy, we may contact you to discuss the role and obtain any confirmations we reasonably require.

 

For the avoidance of doubt, being approached by Finiten does not guarantee that you will be submitted for any role, invited to interview, offered employment, or placed in an assignment.

 
5. Use of your information
​

By applying or engaging with Finiten, you acknowledge that we may use the information you provide to:

  • review and process your application;

  • assess your suitability for a specific role or assignment;

  • communicate with you about your application or other relevant opportunities;

  • verify information you have provided, where appropriate;

  • share your CV and relevant candidate details with a client in relation to a specific vacancy, or on a speculative basis where agreed with you, where we consider there may be a relevant current or future opportunity;

  • keep a record of our communications and recruitment activity;

  • comply with legal, regulatory and professional obligations; and

  • consider you for other suitable roles, in line with our Privacy Notice.

 

Our handling of personal data is governed by our Privacy Notice, which should be read alongside these Terms.

 
6. Candidate submission and representation
​

Finiten will decide, acting reasonably and in accordance with client requirements, whether and when to present your details to a client for a particular vacancy.

​

We may edit or reformat your CV for presentation purposes, for example to improve consistency, remove formatting issues, correct obvious typographical errors, or add a Finiten cover note or candidate summary. We will not knowingly misrepresent your experience, qualifications or background.

​

You should not assume that sending us your CV, or speaking to one of our consultants, means that you have been submitted to a client.

 
7. Speculative introductions
​

Where agreed between you and Finiten, we may share your CV and relevant professional information on a speculative basis with selected existing clients or prospective clients with a view to identifying suitable current or future opportunities, including where no specific live vacancy has been confirmed at the time of submission.

 

Any such speculative introduction will be made in accordance with these Terms and our Privacy Notice.

A speculative introduction does not guarantee that a client or prospective client will have a suitable vacancy, invite you to interview, or make an offer or engagement.

 

You may withdraw from speculative consideration at any time by notifying us.

 
8. Checks, documents and verification
​

You may be asked to provide documents or information required to progress an application or confirm eligibility, including:

  • proof of identity;

  • proof of right to work;

  • proof of address;

  • copies of qualifications, licences or professional registrations;

  • employment references;

  • details relating to conduct, restrictions, conflicts or compliance matters; and

  • any other information reasonably required for the role or assignment.

 

Any offer, introduction, placement or assignment may be conditional upon satisfactory completion of relevant checks.

Where applicable, you must be able to demonstrate your right to work in the relevant jurisdiction before any appointment or assignment begins.

 
9. Your responsibilities during the recruitment process
​

You agree to act honestly, professionally and in good faith in your dealings with Finiten and our clients. This includes:

  • responding in a reasonably timely manner where you remain under consideration for a role;

  • attending interviews, calls, assessments or meetings as agreed, or giving as much notice as possible if you need to cancel or rearrange;

  • preparing appropriately for interviews and selection activities;

  • informing us promptly if you are no longer interested in a role;

  • informing us promptly if you accept another offer, become unavailable, or your circumstances materially change; and

  • not knowingly providing false, misleading or incomplete information at any stage.

 
10. Fair and inclusive recruitment
​

Finiten supports fair and inclusive recruitment practices. If you require any reasonable adjustments at any stage of the application, interview or assessment process, please let us know and we will take reasonable steps to support you and, where relevant, communicate appropriate requirements to the client.

 
11. No guarantee of interview or placement
​

Applying for a role through Finiten, submitting your CV, being approached by a consultant, or taking part in a recruitment process does not guarantee that:

  • you will be contacted;

  • you will be submitted to a client;

  • you will be invited to interview;

  • you will receive feedback;

  • you will be offered a role or assignment; or

  • any placement will proceed to completion.

 

Hiring decisions remain subject to client requirements, candidate suitability, availability, right to work, references, checks, budget, business needs and other factors outside Finiten’s control.

 
12. Temporary, interim and contract assignments
​

Where Finiten recruits for temporary, contract or interim assignments, additional terms may apply before any assignment begins. These may cover matters such as assignment terms, pay arrangements, timesheets, notice, conduct, health and safety, confidentiality, and applicable client-site rules.

Nothing in these Terms creates an employment relationship between you and Finiten unless and until a separate written contract expressly does so.

 
13. Candidate fees
​

Finiten does not charge candidates fees for work-finding services, except where permitted by law.

 
14. Confidentiality
​

During the recruitment process you may receive confidential or commercially sensitive information relating to Finiten, our clients, vacancies, business plans, interview processes, remuneration, products, strategy or other matters.

You agree that you will:

  • keep such information confidential;

  • use it only for the purpose of considering the relevant opportunity;

  • not disclose it to any third party without proper authority; and

  • not use it in a way that could harm Finiten, the client, or the integrity of the recruitment process.

 

This clause does not prevent disclosure where required by law.

 
15. Intellectual property and application materials
​

You retain ownership of the content you submit to us, such as your CV and cover letter. By submitting those materials, you grant us the right to use, store, copy, format and transmit them as reasonably necessary for recruitment, compliance and related administrative purposes, in accordance with these Terms and our Privacy Notice.

 
16. Withdrawal and ending the process
​

You may withdraw your application or stop engaging with us at any time by notifying us.

Finiten may suspend, stop or decline to represent you for a role, or may end our recruitment engagement with you, where we reasonably believe that:

  • information provided is inaccurate, incomplete or misleading;

  • there is a compliance, legal or regulatory concern;

  • there is a conflict of interest or other issue affecting representation;

  • your conduct towards Finiten staff or clients is inappropriate; or

  • continued representation is otherwise not appropriate in the circumstances.

 
17. Third-party platforms and external links
​

Where you apply via or interact with Finiten through a third-party platform, Finiten is not responsible for:

  • the operation, availability or security of that platform;

  • any loss of data caused by that platform;

  • the content, policies or terms of that platform; or

  • any action or omission of the third-party provider.

 

You should review the relevant third party’s own terms and privacy information when using their services.

 
18. Liability
​

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

 

Subject to that, Finiten shall not be liable for any loss, cost or damage arising from:

  • a client’s decision not to progress or hire you;

  • delay, suspension, amendment or withdrawal of a vacancy or assignment;

  • inaccurate information provided by you or a third party on your behalf;

  • failure by you to provide required documents or complete checks in time;

  • acts or omissions of clients or third-party platforms; or

  • circumstances outside our reasonable control.

 

Finiten does not guarantee the availability, suitability, duration, remuneration or outcome of any opportunity.

 
19. Changes to these Terms
​

We may update these Terms from time to time. The latest version published on our website, or otherwise made available to candidates, will apply from the date of publication.

 
20. Governing law and jurisdiction
​

These Terms are governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction in relation to any dispute or claim arising out of or in connection with these Terms, except where mandatory law provides otherwise.
